1. Introduction

Welcome to Planteka, a marketplace for gardening services provided both via video and in person, as well as events and workshops. These Terms and Conditions govern the use of our platform and services. By using our platform, you agree to these terms and conditions.

2. License to use our platform

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Platform subject to these Terms and Conditions.

3. Eligibility

You must be at least 18 years old to use our platform, either as a buyer/customer or as a seller/service provider.

4. Services offered

Events: Includes events related to gardening.
Workshops: Includes instructional sessions on gardening topics, both online and in person. Workshops are in person, unless otherwise indicated in the product description.
Gardening services: Includes in-person and virtual consultations and gardening services at the customer's home or via video call.

5. User obligations

Accurate information: You agree to provide accurate and up-to-date information.
Compliance: You must comply with all applicable laws, regulations, and these Terms and Conditions.

6. User Conduct

Prohibited Activities: Activities such as fraud, harassment, or spamming are strictly prohibited on the platform.
Consequences: Anyone participating in these activities will be expelled from the platform without prior notice and, if necessary, reported to the competent authorities.

7. Sellers and Service Providers

  • Legality: Ensure that all services and products offered comply with relevant laws and regulations.
  • Insurance: Carry adequate insurance for in-person services.

8. Payments and fees

Payment processing: Payments are processed securely through Shopify.

9. Booking and payment for services

  • Bookings: Customers can book services through the platform.
  • Payment method: Payment must be made at the time of booking.

10. Cancellations and refunds

  • For events and workshops:
    If the provider cancels the event or workshop, customers can request a refund or change the date.
    Customers can request a refund or change the date if they cancel at least 48 hours before the event or workshop. Cancellations within 48 hours are not eligible for a refund, unless agreed upon by the workshop provider and the customer.
  • For gardening services: Service providers may cancel up to 24 hours before the scheduled service without penalty. Last-minute cancellations require rescheduling or refund. Customers may cancel services up to 48 hours before the appointment for a full refund. Cancellations within 48 hours are subject to a cancellation fee.

11. Gift card expiration and balance

  • Minimum validity: The validity of the gift card is set by each of the providers on Planteka.
  • Cash refund: If the remaining balance on the card is less than €10, you are entitled to request the remaining amount in cash.

12. Returns and disputes

  • Returns: Return requests must be resolved directly between the buyer and the seller.
  • Disputes: Planteka is not responsible for resolving disputes, but may facilitate communication between the parties.

13. Privacy and data protection

  • Data collection: We collect the personal data necessary to provide our services. Please see our Privacy Policy for more details.
  • Use of data: By using our services, you consent to the processing of your personal data as described in our Privacy Policy.

14. Intellectual property

  • Content ownership: Users retain ownership of the content they publish, but grant Planteka a license to use, display, and distribute this content on the platform.
  • Infringement: If you believe that your intellectual property rights have been infringed, please contact us immediately with the relevant details.

15. Liability

  • Limitation of liability: Planteka is not liable for any indirect, incidental, or consequential damages arising from the use of our platform. Planteka is not liable for any damages, losses, or injuries that occur during or as a result of attending workshops. Customers attend workshops at their own risk.
  • Quality of services: We do not guarantee the quality, safety, or legality of the services and products offered by users.

16. Termination

  • User accounts: We may cancel or suspend your account for violating these Terms and Conditions or engaging in fraudulent activities.
  • Service interruption: Planteka reserves the right to change, suspend, or discontinue any service at any time.

17. GDPR compliance

Rights of the data subject: Under the GDPR, you have the following rights in relation to your personal data:

  • Access: Request access to your personal data.
  • Rectification: Request the correction of inaccurate or incomplete data.
  • Erasure: Request the erasure of your personal data.
  • Restriction: Request the restriction of the processing of your personal data.
  • Data portability: Request the transfer of your data to another service.
  • Objection: Object to the processing of your personal data.

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date.

19. Applicable law and jurisdiction

Applicable law: The law applicable to these Terms and Conditions is that of Barcelona, Spain.
Jurisdiction: Any legal dispute shall be resolved under the jurisdiction of Barcelona, Spain.

20. Indemnification

User liability: Users agree to indemnify and hold harmless Planteka and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the platform or violation of these terms.

21. Modification of services

Right of modification: Planteka reserves the right to modify its services, including features and functionalities, at any time and without prior notice.

22. Copyright infringement

Planteka respects your intellectual property, and if you believe that your work has been copied and used on our website by users of the Planteka platform, please notify us immediately via our contact form. We will immediately inform the responsible entity. If you are not the owner of intellectual property rights or your agent, Planteka will not be able to process claims submitted through this form. Please communicate your concerns to Planteka through the appropriate channel: Sellers can use the form to report inappropriate ads, other sellers, policy violations, etc. Our responsibility will be limited to informing the parties involved.
